It is stated that viewing pornography privately will not constitute an offence. As of date, no provision exists that prohibits such private acts , elevating it as falling within one’s right to free expression and privacy. Watching child pornography is moral wrong not legal wrong. -Madras High Court on Child Pornography. Recently, the Madras high court under S Harish v Inspector of Police and Another case, stated that watching child pornography cannot be considered offence under POSCO (Prevention of Children from Sexual Offence Act) or the Information Technology Act 2000. -Section 67B of the Information Technology Act, 2000 penalizes every kind of act pertaining to child pornography.  1. Whoever publishes or transmits or causes to be published or transmitted material in any electronic form which depicts children engaged in sexually explicit act or conduct; 2. or creates text or digital images, collects, seeks, browses, downloads, advertises, promotes, exchanges or distributes material in any electronic form depicting children in obscene or indecent or sexually explicit manner;3. or cultivates, entices or induces children to online relationship with one or more children for and on sexually explicit act or in a manner that may offend a reasonable adult on the computer resource; 4. or facilitates abusing children online, or records in any electronic form own abuse or that of others pertaining to sexually explicit act with children Are all liable to be punished -POSCO : The Protection of Children from Sexual Offences Act (POCSO for short) was passed in 2012 to comprehensively deal with the issue of sexual offences against children. POCSO not only spells out the punishments for offences, but also sets out a system for support of victims and improved methods for catching offenders. -The Protection of Children from Sexual Offences Act (POCSO) is a gender neutral law Both boys and girls can be victims under POCSO. -Both males and females can be punished for committina an offence under POCSO -Under POCSO 'child' means any person below the age of 18 years. -Punishment The punishment for using a child for pornography is imprisonment for up to 5 years, as well as payment of fine. If the offence is repeated, the term imprisonment can be increased to 7 years.
